Terms & Conditions

1. Introduction

These Terms and Conditions outline the rules and regulations for the use of Hilton Clearance. By using our services, you agree to comply with these Terms and Conditions. If you disagree with any part of these terms, please do not use our services.

 

 2. Definitions

- Company refers to Hilton Clearance.

- Customer refers to the individual or business entity that uses the Company’s services.

- Services refers to the waste clearance services provided by the Company.

- Hazardous Waste refers to any waste that poses substantial or potential threats to public health or the environment and includes, but is not limited to, asbestos, chemicals, medical waste, and flammable substances.

 

3. Scope of Services

- The Company provides waste clearance services for domestic and commercial properties.

- The Company is NOT licensed to collect or dispose of hazardous waste.

- The Services are limited to the removal of non-hazardous waste only, which includes general household waste, garden waste, construction debris, and similar items as detailed on our website.

 

4. Customer Responsibilities

• The Customer must inform the Company of the nature of the waste to be collected at the time of booking.

• The Customer is responsible for ensuring that no hazardous waste is included in the materials provided for collection.

• The Customer is responsible for ensuring that the Company has safe and adequate parking and access to the property for the collection of waste. This includes:

• Ensuring that there are no parking restrictions that would prevent the collection vehicle from accessing the property.

• Covering any parking fees or permits required for the collection vehicle to park near the property.

• Ensuring clear and safe access to the waste, both inside and outside the property, including access via stairs, gates, or driveways.

• If parking or access issues prevent the collection from taking place, the Company reserves the right to charge a cancellation fee or an additional fee for any delays or alternative arrangements.

• If hazardous waste is found during the collection, the Company reserves the right to refuse service, and the Customer may be charged for the visit.

 

5. Payment Terms

• Call-Out Fee: The Company charges a call-out fee to secure the booking. This fee is deducted from the total cost of the waste collected at the time of collection.

• Re-Quoting for Additional Waste: If there is more waste than initially quoted, the Company will provide a new quote and take an additional payment on the day of collection. Alternatively, the Customer may choose to have only the originally booked waste collected.

• Refunds for Less Waste: If the amount of waste collected is less than what was initially quoted and prepaid, the Customer will receive a refund for the difference within 5 working days.

• Fixed Pricing: The Company offers fixed prices for specific collection types, such as sofa removal. These are usually prepaid as the final cost is known, unlike when collecting various types of waste from the property.

• Payment on the Day: Any additional payments due on the day of collection must be made at the start of the job by BACS or cash. Card payment options will be available soon. This ensures that there are no delays or extra costs incurred due to payment issues

 

6. Prohibited Waste

The Company will not collect the following items:

- Asbestos

- Chemicals, solvents, and paints

- Gas cylinders

- Medical or biological waste

- Flammable materials

- Oil, petrol, and other fuel containers

- Plasterboard (unless specifically arranged)

- Any other waste classified as hazardous under UK law

 

 7. Cancellation and Rescheduling

- Cancellations or rescheduling requests must be made at least 24 hours before the scheduled collection time. Failure to do so may result in a cancellation fee.

- The Company reserves the right to cancel or reschedule the service in case of unforeseen circumstances (e.g., severe weather, access issues).

 

 8. Liability

- The Company will not be liable for any loss or damage incurred by the Customer due to the refusal to collect hazardous waste.

- The Company is not responsible for the improper disposal of hazardous waste if the Customer has failed to declare such items.

- The Customer agrees to indemnify and hold the Company harmless from any claims, damages, or expenses arising from the Customer's breach of these Terms and Conditions.

 

9. Waste Disposal and Recycling

- The Company aims to recycle as much of the waste as possible and will dispose of all waste in compliance with UK regulations.

- The Company provides documentation confirming the proper disposal of waste upon request.

 

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
